New Book: Practical Aspects of Cybercrime and Digital Evidence

Tirant lo blanch has published the book that I co-authored with Andres Velazquez titled: Practical Aspects of Cybercrime and Digital Evidence [ISBN 9788413786087]. The book is a joint effort of two professionals of the legal and digital forensic fields who have devoted a large part of their professional activities to advising and training authorities of the judiciary, governments, international organizations, corporations, academic institutions and research centers active in the field of cybercrime and digital evidence.

The seven chapters that make up this book analyze in a concise and detailed manner and from a practical perspective the most debated and controversial topics of the international agenda related to cybercrime, electronic evidence and cross-border access in criminal proceedings. The book is aimed at all types of readers, mainly those linked to the administration of the criminal justice system, legislators and policy makers, international and regional organizations, research and academic centers, digital forensic investigators, as well as professionals and students interested in the subject.

The book is divided in three parts. The first part titled: “Internet, Cybercrime and International Cooperation Instruments to Combat Cybercrime” covers the first three chapters. The second part titled “Jurisdiction, Cross-Border Access to Data and Applicable Legislation to Cybercrime Investigations in the International Sphere and in Latin America” consists of chapters four, five and six. This part covers an analysis of current legislation on cybercrime and electronic evidence from ten selected countries of Latin America and the Caribbean. The third part titled: “Electronic Evidence, International Standards, Comparative Legal Frameworks and their relevance under Criminal Procedure” consists of chapter seventh. This chapter analyzes relevant aspects of the electronic evidence for cybercrime investigations including the most relevant international legal instruments and legislation in this area.

Likewise, the book analyzes and reviews the applicable international instruments, as well as the substantive and procedural legislation of different countries to investigate, adjudicate and prosecute cybercrimes and to preserve digital evidence. It includes a comparative analysis of the recommendations and best practices of international organizations, judicial cooperation networks, public-private partnerships, as well as a synthesis of the most outstanding cases on jurisdiction and cross-border access resolved in the United States and European countries.

As a result of the confinement that the current pandemic has brought, the book includes a section on “COVID-19 and Cybercrime” that analyses the most relevant attacks and landmark cases, statistics and the activities of international organizations to counter and deal with these attacks that will continue to impact various sectors of the economy and society in the following years.
